Where the university has reason to believe or had knowledge that the link provided leads users to copyright infringing material, it is likely that the university may be held liable for authorising infringement of copyright.

As UEL holds a licence from the Educational Recording Agency (ERA) it is possible to use an audio or video recording of a BBC programme and put it on UELPLus.  However, it needs to be noted that the VLE has to be password protected and access to the audio or video is available only by means of a secure authentication and only to students and staff who are involved in the particular course of study.  Access to the content should also be restricted to on–campus.  Off-campus access to the audio or video is not covered by the standard licence UEL subscribes to.

Playing or showing of legal video clips from YouTube for learning or teaching purposes by itself is not illegal. But, it would be illegal to show in class clips from YouTube that are copyright infringing or illegal.

There are a number of issues relating to the use of copyright material in an institutional repository. The main issues relate to obtaining appropriate rights clearance, clarifying copyright ownership in jointly authored materials and using materials already published in other mediums (e.g. as articles in journals). There is a wealth of guidance available regarding the legal aspects of repositories, including copyright on the publications web page of JISC Legal.
